What Is a Family Residence Permit? Who Can Apply?
The family residence permit is one of the most commonly requested residence types in Türkiye. It enables foreign family members of Turkish citizens or foreigners legally residing in Türkiye to live together in the country. The family residence permit is regulated under Articles 34–37 of the Law on Foreigners and International Protection No. 6458 and Articles 30–34 of its Implementing Regulation.
Who Can Obtain a Family Residence Permit?
According to the Law, a family residence permit may be issued based on one of the following sponsors:
• Turkish citizens,
• Persons covered by Article 28 of Law No. 5901,
• Foreigners holding a valid residence permit in Türkiye,
• Refugees or beneficiaries of subsidiary protection.
The following foreign family members of these sponsors may obtain a family residence permit:
a) The foreign spouse,
b) The sponsor’s or spouse’s minor child,
c) The sponsor’s or spouse’s dependent adult child.
If the sponsor has more than one spouse, only one spouse may be granted the family residence permit; however, all children are eligible.
When applying on behalf of a child, a notarized consent letter from the parent who holds joint custody is required.
Holders of a family residence permit may enroll children in primary and secondary education without obtaining a student residence permit until the age of 18.
Can Family Residence Permit Holders Switch to a Short-Term Residence Permit?
Yes. The Law allows a transition to a short-term residence permit in certain situations:
1. In case of divorce
• The foreign spouse may transition to a short-term residence permit if they have lived in Türkiye on a family residence permit with a Turkish spouse for at least 3 years.
• The 3-year requirement does not apply if the foreign spouse proves by court decision that they were a victim of domestic violence.
2. In case of the sponsor’s death
Foreigners who hold a family residence permit dependent on the deceased sponsor may transition to a short-term residence permit.
3. Children who turn 18
Foreigners who have lived in Türkiye on a family residence permit for at least 3 years and reach the age of 18 may apply for a short-term residence permit.
