Duration of the Family Residence Permit
The family residence permit may be issued for a maximum of three years at a time.
However, it cannot exceed the validity period of the sponsor’s residence permit.
Conditions for a Family Residence Permit
Conditions for the family residence permit are outlined in Article 35 of the Law on Foreigners and International Protection No. 6458. These conditions apply separately to both the sponsor and the applicant family members.
Requirements for the Sponsor
The sponsor must:
• Have valid health insurance covering all family members,
• Earn monthly income of at least one-third of the minimum wage per family member,
• Prove via a criminal record that they have not committed crimes against family unity in the past 5 years,
• Have legally resided in Türkiye for at least one year,
• Be registered in the address registration system.
Requirements for the Applicant Family Members
Applicant family members must:
• Submit documents appropriate to the purpose of stay,
• Demonstrate the intention to live together with the sponsor,
• Be at least 18 years old in the case of spouses,
• Not fall within the scope of entry bans under Article 7,
• Not have entered into marriage solely for the purpose of obtaining a residence permit.
When Is a Family Residence Permit Rejected, Cancelled, or Not Extended?
A family residence permit may be refused, cancelled, or not renewed in the following situations:
• Failure to meet or maintain the required conditions,
• Using the permit for purposes other than its intended purpose,
• The existence of a valid deportation order or entry ban for the foreigner.
These situations are evaluated strictly by the administration, and the family residence permit is a category in which authorities exercise broad discretionary power.
